1. The platform
Switch My House connects homeowners who want to buy and sell at the same time. We provide the matching, chat, offer and deal-tracking tools; the decision to transact, and the transaction itself, is always between you and the other party, supported by licensed professionals where you choose to engage them.
2. Your account
- You must be 18 or over and able to legally deal with the property you list.
- Every account includes every feature, there are no paid membership tiers.
- You’re responsible for keeping your login secure and for what happens on your account.
- Listings must be accurate. We moderate new listings before they go live and may pause or reject listings that are misleading, duplicated or not owned by you.
3. Fees
You don’t pay Switch to register, list, match, like or chat. When a transaction facilitated through the platform settles, a platform fee of $2,500 + GST applies. This fee is invoiced to your nominated settlement agent and added to your settlement fees and charges. You will be asked to nominate a settlement agent before settlement, and the fee applies whichever settlement agent you choose, including one you bring yourself. Agent assistance services (viewing representation at $2,000 + GST per party, buyers advocacy at $2,500 + GST, settlement services) are separate engagements between you and the relevant licensed professional, at the prices quoted to you before you engage them.
4. No financial or legal advice
Nothing on Switch My House, including price ranges, valuation prompts, deal progress steps, chat content or any material we publish, constitutes financial, legal, tax or real estate advice. Property transactions are significant decisions: obtain independent advice from a licensed professional before committing to buy, sell or swap. Price ranges shown on listings are owner estimates unless stated otherwise.
5. Conduct
- Treat other members respectfully. Harassment, discrimination or misleading conduct isn’t tolerated.
- Chats open only when both parties agree (or when an owner accepts your request). Don’t attempt to contact members outside these channels without their consent.
- We may suspend or close accounts that breach these terms, and remove content that’s unlawful or harmful.
6. Community content and zero tolerance
Listings, photos, chat messages and offers are member-generated content. We have zero tolerance for objectionable content or abusive behaviour: harassment, hate, threats, sexual content, scams, and listings that are fraudulent or not yours to list. Report any content or member that concerns you to hello@switchmyhouse.com.au and we will review within 24 hours, remove content that breaks these terms, and eject the member responsible. We may also remove content and suspend accounts on our own initiative, without notice, to keep the platform safe.
7. Verification
Ownership verification is a safety feature, not a legal guarantee. A “verified owner” badge means we’ve sighted a document consistent with ownership, always complete your own due diligence, title searches and contract checks through your settlement agent or solicitor.
8. Liability
To the extent permitted by law (including the Australian Consumer Law), Switch is not a party to any transaction between members and is not liable for the conduct of members, the condition of properties, or the outcome of any transaction. Nothing in these terms excludes rights that cannot be excluded under Australian law.
9. Changes and governing law
We may update these terms from time to time; we’ll notify you of material changes in-app. These terms are governed by the laws of Western Australia, and you submit to the jurisdiction of its courts.
